The petitioner, already in custody, seeks bail in connection with Sessions Trial No. 806 of 2017, arising out of Meenapur P.S. Case No. 288 of 2017 registered under Sections 399,402,412,414 of the IPC and 25(1-b)A, 26/35 of the Arms Act.
Allegation in brief is that petitioner was apprehended by the police with one loaded country made pistol and one mobile in his possession.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent and seeks bail on the ground of parity as one of the co-accused Sunil Kumar and Ranjeet Sahani@ Ranjeet Kumar have been admitted on bail by
Patna High Court Cr.Misc. No.30460 of 2018(3) dt.18-06-2018 2/2 coordinate Bench of this Court vide Cr. Misc. No. 13164 of 2018. In the present case, petitioner is in custody since 04.08.2017.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Deepak Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 13th Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial No. 806 of 2017, arising out of Meenapur P.S.
