The petitioner seeks bail in a case registered under Sections 387, 506 of the Indian Penal Code.

Allegation is that the informant received one unknown call on his mobile, by which he was demanded Rs.5 lacs and he was threatened to kill if not paid rangdari. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.01.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has

Patna High Court CR. MISC. No.38955 of 2019(2) dt.27-06-2019 2/2 falsely been implicated in the present case. The mobile in question does not belong to the petitioner. The name of the petitioner has come on confessional statement of co-accused. Except for this, there is no other substantive evidence to suggest his implication in the present case.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Darigaon) P.S. case No.1520 of 2018.
