The petitioner seeks bail in anticipation of his arrest in connection with Sour Bazar P. S. Case No.466 of 2019, instituted for the offence under Sections 147, 148, 149, 341, 323, 307, 384, 379, 504, 506 of the Indian Penal Code and later on, Section 302 I.P.C. was also added.
Though the petitioner has been named in the first information report, but there is no specific accusation against him. Several persons, who are related to the prosecution side, have been made accused in this case because of past enmity. There is a counter-version of the occurrence as well, which has been lodged by the wife of the petitioner. The deceased died
Patna High Court CR. MISC. No.39198 of 2020(2) dt.01-06-2021 2/2 after ten days of the occurrence. A Title Suit also is pending between the parties with respect to the dispute over a piece of land.
Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the Court below within a period of eight weeks from the date of receipt/ production of a copy of this order, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P. S. Case No.466 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
