JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-06-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 8, 15(c), 25, 27A and 29 of the NDPS Act.
On secret information one truck has been stopped at check post Surya Mandal Dobhi. It was found that the truck was potato loaded but in the middle 70 packets of straw believed to poppy straw has been recovered and seized.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that petitioner is not the owner of the said
Patna High Court CR. MISC. No.979 of 2021(5) dt.21-06-2021 2/2 vehicle rather he is driver of the said truck. He further submits that petitioner is languishing in judicial custody since 01.05.2019.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with NDPS Case No. 03 of 2020/40 of 2019 arising out of NCB Case No. NCB/PZU/V/11/2019 pending before the court of the learned District and Sessions Judge-XII, Gaya.
