NILU AGRAWAL ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in connection with Sonepur P.S. Case No. 435/16 for offences punishable under Sections 272, 273, 420, 120-B of the Indian Penal Code and Sections 30(a)/38/41 of the Bihar Prohibition and Excise Act. The prosecution case, as lodged by the police personnel, is that huge consignment of Indian made foreign liquor loaded on a truck was intercepted by the police near Rimjhim hotel and some of the accused persons were apprehended, who named the petitioner. Allegation upon the petitioner is that huge amount of money was transferred in lieu of said illicit liquor.

No.32272 of 2017 (4) dt.09-08-2017 2/3 It has been submitted by the learned counsel for the petitioner that he is innocent, deals in marble business, neither the truck is in his name nor he had any connection with the illicit liquor being brought in Bihar and is a resident of Haryana. He submits that two of the co-accused named by other accused apprehended by the police, have since been granted privilege of bail by a Coordinate Bench of this Court in Cr. Misc. No. 9336 of 2017 on 04.04.2017. He further submits that nothing has been recovered from his possession nor he has been apprehended by the police carrying illicit liquor.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record and that other accused persons have been granted privilege of bail by Coordinate Benches of this Court, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Saran at Chapra, in connection with Sonepur P.S. Case No. 435/16, subject to the condition that both the bailors would be close relative of the petitioner having
