The petitioner seeks bail in S.T. No.253 of 2018 arising out of Khodawanpur P.S. case No.131 of 2016 registered under Sections 302, 147, 148, 149 of the Indian Penal Code and 27 of the Arms Act, pending in the court of Additional Sessions Judge-5, Begusarai.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is one of the assailants. A report was called for from the court below regarding the stage of trial. It has been reported that three prosecution witnesses have already been examined and the trial is expected to be concluded within a period of six months.

Patna High Court CR. MISC. No.38174 of 2019(3) dt.11-09-2019 2/2 Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.
