The petitioner seeks regular bail in connection with Ramnagar P.S. Case No. 455 of 2017, registered for the offence punishable under Sections 323, 324, 325, 376, 420 of the Indian Penal Code and Sections 3/ 4 of the Dowry Prohibition Act. The allegation of the informant is that after her marriage, her husband i.e. the petitioner herein is demanding dowry and is also refusing to keep her in his house. The learned counsel for the petitioner submits that the petitioner is ready to keep the informant with full dignity and to that extent, he is willing to take the informant from the court below.
The learned counsel appearing on behalf of the informant submits that in case, the petitioner keeps the informant with full dignity, he has no objection for grant of bail
Patna High Court Cr.Misc. No.20503 of 2018(4) dt.17-05-2018 2/2 to the petitioner herein.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Bagaha, West Champaran in connection with Ramnagar P.S. Case No. 455 of 2017.
It is further directed that the petitioner shall furnish an undertaking before the learned trial court at the time of grant of bail to the effect that he would be keeping the informant along with him in his residence with full dignity and in case, any complaint is made by the informant before the trial court, the learned trial court would examine the veracity of the complaint and take steps accordingly. In case, it is found that the petitioner has again engaged in torture or demand for dowry then the present privilege of bail shall stand cancelled. (Mohit Kumar Shah, J) ajay gupta/- U T
