JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-05-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Shankarpur P.S. Case No. 32 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on search of the house of both petitioners, one gallon from each house containing five litres country-made liquor, recovered.

Learned counsel for the petitioners submits the petitioners having no criminal antecedent, are in custody since 26.03.2017.

Having regard to the facts and the circumstances of

No.23209 of 2017 (2) dt.18-05-2017 2/2 the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Madhepura in connection with Shankarpur P.S. Case No. 32 of 2017, subject to the condition that out of two sureties, one surety must be the close relative of the petitioners.
