Petitioners apprehend arrest in a case registered for the offence punishable under Sections 498A, 506/34 and other allied sections of Indian Penal Code.
As per prosecution case, allegation against these petitioners is that they assaulted and tortured the informant for dowry.
Learned counsel appearing for the petitioners submits
Patna High Court CR. MISC. No.40493 of 2022(2) dt.28-11-2022 2/2 that petitioners are innocent and have falsely been implicated in this case and they never demanded dowry from the informant. As a matter of fact, informant fell down in bathroom and got her leg fractured. Petitioners are in-laws of the informant. Petitioner Nos. 1 is father-in-law, petitioner No. 2 is mother-in-law and petitioner No. 3 is sister-in-law of the informant. It is submitted that petitioners are separate in mess and property. Petitioners have got clean antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Bhagalpur in Bhagalpur Mahila P. S. Case No. 58 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) navya/- U T
