Petitioner, already in custody since 2.1.2018, seeks bail in Salaiya PS Case No. 61 of 2014, registered under Sections 302, 201 and 34 of the IPC.
Learned Counsel for the petitioner submits that the informant is not the eye witness, the petitioner has been made accused only on the basis of suspicion and only evidence during investigation is that on the previous day in the evening the deceased was seen in the company of the petitioner.
Having considered the said facts and circumstances, the petitioner Sitabi Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VIII Aurangabad in connection with Salaiya PS Case No. 61 of 2014 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner; and (ii) The petitioner shall appear before the trial court on each
Patna High Court Cr.Misc. No.14317 of 2018 (3) dt.11-05-2018 date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
