The petitioner seeks bail in Modal Thana Sasaram P.S. Case No. 1257 of 2018, instituted for the offence under Section(s) 224, 225, 353, 120(B), 414 of Indian Penal Code, Sections 25(1-B), 26(11) and 35 of Arms Act. Counsel for the petitioner submits that petitioner was already in custody at the time of occurrence. It is alleged in the written report that while petitioner was brought for production before Juvenile Justice Court, four accused persons as named in the written report tried to set the petitioner free from custody. They were apprehended. It is further alleged that on search, one loaded pistol has been recovered from co-accused Nasin Ansari. One cartridge each has

Patna High Court CR. MISC. No.40270 of 2019(2) dt.05-07-2019 2/2 been recovered from co-accused Sonu and Manish. Counsel for the petitioner submits that petitioner was in Police custody. He has been made accused merely on suspicion. He is in custody since 5.10.2018.

Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, in connection with Modal Thana Sasaram P.S. Case No. 1257 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
