The petitioner seeks bail in connection with Akbarpur P.S. Case No.27 of 2017 registered under Sections 147, 148, 149, 341, 307 and 302/504 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that 9 persons, named in the F.I.R., including the petitioner surrounded the informant Prince Kumar and his uncle Shailendra Singh alias Nawal Singh. Thereafter, the co-accused Lavkesh Singh alisas Feku Singh caught hold of Shailendra Singh alias Nawal Singh, the uncle of the informant Prince Kumar, and the co-accused Kaushal Singh, shot fire at him

Patna High Court Cr.Misc. No.24511 of 2017 (2) dt.29-06-2017 2/2 due to which he fell down. While Shailendra Singh alias Nawal Singh, the uncle of the informant Prince Kumar, was rushed to Sadar Hospital Nawada but he was declared dead by the doctor. Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. alongwith eight others but the specific allegation is against the co-accused Lavkesh Singh alia Feku Singh, who caught hold of the deceased Shailendra Singh alias Nawal Singh, the uncle of the informant, and the co-accused Kaushal Singh, who shot fire at him. The petitioner can only be said to be a member of mob. The petitioner having no criminal antecedent is in custody since 23.03.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Nawada, in connection with Akbarpur P.S. Case No.27 of 2017.
