Deceased was killed in running train and the first information report was lodged against unknown persons.

Subsequently, in course of investigation, statement of father of the deceased was recorded who expressed his suspicion against the petitioner. Petitioner was enquired by the police while he was lodged in jail and allegedly, the petitioner confessed his guilt. It appears that except the aforesaid material as well as criminal antecedent of the petitioner, there appears to be nothing against him.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge V, West
