JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Chautham P.S. Case No. 42 of 2015 registered under Sections- 328, 304(B), 201/34 of the Indian Penal Code.

Petitioner happens to be elder brother-in-law of the deceased. The marriage of deceased had taken place in the year, 2009 and she died on 28-03-2015 i.e. near about after six years of her marriage. Moreover, there is nothing in the first information report to show that any illegal demand had been made by the petitioner.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.29011 of 2015 (2) dt.27-07-2015 2/2 co-accused, Bhuneshwar Singh and two others have already been admitted to anticipatory bail by coordinate bench of this court.

Accordingly, it is ordered that let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chautham P.S. Case No. 42 of 2015 to the satisfaction of Sri Santosh Kumar' Judicial Magistrate-Ist Class, Khagaria subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
