JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 404 of 2018 instituted for the offences punishable under Sections 307, 498A, 323, 504, 506 of the Indian Penal Code and Sections 3/4 of dowry Prohibition Act.
Petitioner happens to be husband of the complainant and there is allegation of demand of Rs.50,000/- and for that torturing the complainant and ousting her from the house. In this case, after appearance of opposite party No.2 the matter was referred to the Mediation centre but it appears that mediation failed.

No.38553 of 2019(6) dt.18-12-2019 2/2 Submission of learned counsel for the petitioner is that no specific allegation has been attributed against him, rather there is general allegation against all the accused persons and petitioner was ready for one time settlement but as complainant demanded Rs.5 lac and petitioner was ready to pay Rs.2 lac, as such mediation failed.

In view of above facts and circumstances, this application is allowed. The provisional bail granted to the petitioner by order dated 1.7.2019 is confirmed. (Vinod Kumar Sinha, J) spal/- U T
