Petitioner, already in custody, seeks bail in connection with Bithan PS Case No.179 of 2017, registered under Section 302 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that the father of the informant received a phone call on his mobile while he was watching dance being organized in front of his house and thereafter he left the place and just after firing sound was heard when the informant reached there found his father dead. The father of the informant was killed by firearm.

Learned counsel for the petitioner submits that the petitioner has been made accused only on the basis that the said

No.15814 of 2018(3) dt.11-05-2018 2/2 phone call was received by the deceased from the mobile of the husband of the petitioner and it is alleged that the deceased had illicit affair with the petitioner, so on that account he was eliminated, the relationship was protested by the family members of both sides and in any case the petitioner would not have killed her own paramour, if that was the truth. Having considered the aforesaid facts and circumstances, petitioner Chinta Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Rosera, Samastipur in connection with Bithan PS Case No.179 of 2017.
