JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 448 and 380 of the Indian Penal Code and 3(i) (x) SC/ST (POA)Act.
It is alleged by the informant that the petitioner entered in her house in the night and committed theft, who was caught by the villagers on the spot. The family members of the accused arrived there and abused her calling her caste name. On behalf of the petitioner, it has been submitted that the petitioner has no criminal antecedent. It is further submitted that the petitioner has been made accused due to mistake of fact. So far offence under SC/ST(POA)Act is concerned, same is not attributed as no occurrence is said to

On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ranjeet Kumar, Judicial Magistrate, 1st Class, Sasaram, District- Rohtas in connection with Chenari P.S.Case No. 77/2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
