The petitioner seeks bail in a case registered for the offence punishable under Sections 387 of the IPC and later on 414 of the Indian Penal Code and Sections 10, 11, 13(a), 17 of the UAP Act has been added.
Prosecution case as lodged by the informant is that naxalites of Communist Party have pasted pamphlet which comprises threatening of paying levy and demanded extortion money from him.
Learned counsel for the petitioner submits that petitioner is innocent, not named in the FIR and has been falsely implicated in this case due to suspicion. He submits that petitioner is driver of the informant and has been carrying
Patna High Court CR. MISC. No.38056 of 2020(3) dt.05-03-2021 2/2 money on behalf of the informant to deliver the person whom the informant has told to give. He submits that after apprehension by the police, the police obtained a confessional statement from the petitioner wherein he disclosed about his involvement in the case, which is not admissible in law. He further submits that petitioner is languishing in judicial custody since 14.05.2020.
In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Arwal in connection with Kinjer P.S. Case No. 17 of 2020, G.R. No. 227 of 2020.
