This is a petition for grant of anticipatory bail for offence under Sections 489A, 489B and 489C of the Penal Code.

It is alleged that at the instance of one Rustam Ansari seven notes of rupees one thousand denomination and one note of rupees five hundred denomination, said to be counterfeited, have been recovered from the house of Ayub Ansari. However, during investigation it has come that that the case was managed by this petitioner being the Mukhiyapati to falsely implicate Ayub Ansari and he was instrumental in installing the money for false implication. The learned counsel for the petitioner submits that there is no clear evidence in the case diary that who has been installed and a suspicion has been raised.

Patna High Court Cr.Misc. No.36793 of 2014 (3) dt.20-04-2015 2/2 However, going through the case diary, it is apparent that processes under Sections 82 and 83 of the Criminal Procedure Code have been issued against the petitioner.

Having regard to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail is rejected.

If the petitioner surrenders and prays for regular bail, that may be considered on its own merit without being prejudiced of this order. (Gopal Prasad, J) SA/- U √ R √
