JUSTICE RAKESH KUMAR ORAL ORDER 15-12-2016 Heard Sri Dhirendra Nath Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 31.07.2016 in Munger Kotwali P.S. Case No.207/2016 registered for the offence under Sections 20/22 of N.D.P.S. Act, has prayed for grant of bail.
By way of referring to the statement made in paragraph-3 of the petition, it was submitted by learned counsel for the petitioner that the petitioner is having clean antecedent and in this case recovery of about 4 Kg of Ganja was shown from the house of the petitioner. It has been argued that the petitioner is aged about 80 years. It has also been argued that recovered Ganja is much below the commercial quantity.
Patna High Court Cr.Misc. No.44416 of 2016 (2) dt.15-12-2016 2/2 Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner.
Keeping in view the nature of accusation and clean antecedent of the petitioner, let the petitioner, namely, Tarni Mandal be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Munger in connection with Kotwali P.S. Case No.207/2016.
