The Petitioner apprehends his arrest in connection with Tajpur P.S. Case No.215 of 2022, registered for the offences punishable under Sections 341, 323, 307 and 34 of the Indian Penal Code as well as under Section 27 of the Arms Act. The petitioner alongwith 6-7 other accused persons are said to have entered into the house of the informant and made firing.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got three criminal antecedents as stated in paragraph-3 of the bail application. It is further submitted that no specific overt act is alleged against the petitioner.

Patna High Court CR. MISC. No.40436 of 2022(2) dt.22-11-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts that no specific overt act is alleged against the petitioner and no one got any injury in the present occurrence, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Samastipur in connection with Tajpur P.S. Case No.215 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
