JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in Complaint Case no.670(C) of 2012 for the offences under Sections 498A, 323, 494 and 120 of the I.P.C.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that marriage of the complainant was solemnized with the petitioner on 8.5.2004. After one year they started demanding dowry and on non-fulfillment of the same they assaulted and tortured the complainant. It is further alleged that on 24.4.2012 the petitioner remarried to one Suman kumari.

Patna High Court Cr.Misc. No.27994 of 2015 (2) dt.23-07-2015 2/2 It is submitted on behalf of the petitioner that petitioner is ready to keep the complainant but the same is not acceptable to her. The petitioner is ready to deposit Rs.1500/- per months in the court below which shall be released in favour of the complainant.

On behalf of the State it is submitted that the petitioner is named in the complainant.

Considering the aforesaid facts and circumstances, petitioner is directed to deposit Rs.1500/- per month in the court below in favour of the complainant and on his doing so, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the S.D..J.M., Danapur, in Complaint Case No.670 (C) of 2012 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
