This application for anticipatory bail arises out of Special Case N0. 06 of 2019 arising out of Jogbani P.S. Case No. 79 of 2019, disclosing offences under Sections 21©/22 of the NDPS Act and Sections 27(b)/28 read with Section 36 of the Drugs and Cosmetics Act.

Considering the fact that the petitioner has criminal antecedent as has been recorded in the order of the learned Sessions Judge, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

This application is rejected.

However, the petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail

Patna High Court CR. MISC. No.41367 of 2019(3) dt.27-09-2019 2/2 shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
