2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 342, 323, 376, 504 and 506 of the Indian Penal Code.

3. As per prosecution case, it is alleged that on 06.02.2024 at about 11 PM, while husband of informant was not in the house, this petitioner, in an inebriated condition, entered into house of informant and committed rape with her also also captured video of the occurrence. It is further alleged that the petitioner continued the act on the threat of making the video viral.

4. It is submitted by learned senior counsel for the

Patna High Court CR. MISC. No.41249 of 2025(3) dt.19-09-2025 2/2 petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case with ulterior motive. Charge-sheet has already been submitted that petitioner, having no criminal antecedents, is in custody since 12.02.2025.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he committed rape with the informant, captured a video of the occurrence and continued the act on the threat of making the video viral. It is further alleged that during course of investigation, 12 years old daughter of informant has supported the prosecution case.

6. Considering the facts and circumstances of the case, specific and direct nature of accusation, materials that have surfaced during course of investigation and gravity of offence, the prayer for grant of bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
