This Court cannot grant any relief to the petitioner for declaration of a result or issuance of any final mark-sheet under the controversial circumstances, which have been narrated in detail in the counter affidavit.

A reading of the counter affidavit would indicate that there is interpolation, over-writing in the admit card and verification of the tabulation register does not reveal that any candidate with the name and details of the petitioner, matches therein. In fact the reserve tabulation register at the Board throws up the name of one Kumar Shashi Prabha Tiwari.

Patna High Court CWJC No.4748 of 2011 dt.28-08-2015 2/2 In the above circumstances, Court is disinclined from passing any order in favour of the petitioner. No discretion can be exercised in the given facts.

Writ application is dismissed.
