JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being elder brother of the husband of the informant is languishing in custody since 2.8.2016in a case registered for the offences punishable under Sections 341,323,315,498A,504 and 506/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.

The accusation is of torture and administration of some medicine to the informant as a result of which her pregnancy got terminated. It is alleged that the accused persons including the petitioner got married the husband of the informant with some other lady.

It is submitted by the learned counsel for the petitioner that the thrust of accusation is against the husband of the

Patna High Court Cr.Misc. No.40393 of 2016 (2) dt.21-09-2016 2/2 informant and petitioner resides separately from the husband of the informant.

Considering the thrust of accusation against the husband of the informant, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Munsif cum J.M., Supaul in connection with Supaul Mahila P.s. Case No. 73 of 2016.
