The petitioners seek bail in a case instituted under Sections 30(A) and 30(1) of Bihar Prohibition and Excise Act, 2016.

It is alleged that 35 litres of foreign liquor and 52 litres of country made liquor is said to have been recovered from the possession of the petitioners.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 16.01.2017. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. It is alleged

Patna High Court Cr.Misc. No.23519 of 2017 (2) dt.24-05-2017 2/2 that 35 litres of foreign liquor and 52 litres of country made liquor is said to have been recovered from the possession of the petitioners. There is no compliance of section 100 of the Cr.P.C. On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J-IV, Bhagalpur, in connection with Sanokhar P.S. Case No. 09 of 2017. (Sudhir Singh, J) Amit/- U T
