Petitioner is in custody in connection with Parbatta P.S. Case No. 89 of 2017 giving rise to G.R. No. 1304 of 2017 for offence under Sections 302, 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent, he is in custody since 19.01.2018. Learned counsel submits that the FIR was lodged against the unknown and the name of the petitioner surfaced in this case on the basis of confessional statement of Akshaya Mandal. Learned counsel submits that the other co-accused whose named surfaced on the confessional statement of the said Akshaya Mandal has been granted bail, namely Mithun Mandal
Patna High Court Cr.Misc. No.30022 of 2018(3) dt.07-06-2018 2/2 was granted bail vide order dated 28th of feb 2018 in Cr. Misc. No. 1967 of 2018 and Hare Ram Mandal was granted bail vide order dated 26.04.2018 in Cr. Misc. No. 24337 of 2018. Considering the fat that on similarly circumstance the other co-accused have been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Naugachiya, Bhagalpur in connection with Parbatta P.S.
