The petitioner seeks bail in Terhagachh P.S. Case No. 58 of 2016, registered for the offence punishable under Section 47A of the Bihar Excise (Amendment) Act, 2016. The informant alleged that five persons were going on two cycles with country made liquor. The petitioner was apprehended on chase and he is said to have disclosed name of other accused persons.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and he is in jail since 27.08.2016. The petitioner has already remained in jail for more than four months.

Considering the facts aforesaid, the petitioner above

Patna High Court Cr.Misc. No.54464 of 2016 (2) dt.10-01-2017 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Kishanganj in Terhagachh P.S.
