JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.
Petitioner is in jail custody since 29.01.2016 on the accusation that he made attempt to press the neck of police official when informant and others attempted to nab him in connection with Town P.S. Case No. 11 of 2016. It is also stated that petitioner confessed his involvement in Town P.S. Case No. 11 of 2016 and also disclosed that he used forged Sim cards and on the basis of his disclosure one stolen mobile was recovered from possession of co-accused, Lalan Paswan.
Patna High Court Cr.Misc. No.40400 of 2016 (2) dt.29-09-2016 2/2 Submission on behalf of the petitioner is that neither informant nor any other police official sustained any injury and as a matter of fact, the informant lodged this case with exaggerated story. It is further submitted that nothing has been recovered from conscious possession of the petitioner and moreover, having more or less similar allegation, several co-accused have already been granted privilege of bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S. Case No. 18 of 2016.
