JUSTICE SUDHIR SINGH ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 363 and 366(A)/34 of the I.P.C. Allegation is that the accused persons including the petitioner kidnapped the daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.4.2017. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. Subsequently compromise petition has also been filed in the court below, which is Annexure3 to the present application. On behalf of the State, it is submitted that the

Patna High Court Cr.Misc. No.23855 of 2017 (2) dt.24-05-2017 2/2 petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Forbesganj (Simraha) P.S. case No.30 of 2017.
