1. Heard the parties.
2. The petitioner apprehends her arrest in connection with Madhepura (Bharrahi) P.S. Case No. 1279 of 2024 dated 03.11.2024 registered under Sections 137(2), 87, 3(5) of the B.N.S. 2023.
3. As per the first information report on 28.10.2024 in the morning the informant found his minor grand daughter missing from her room. Upon search, the informant came to know that Chhotu Yadav along with his family members has kidnapped the informant's grand daughter for the purpose of marriage.
4. Learned counsel for the petitioner submits that petitioner is the mother of the co-accused Chhotu Yadav with whom the victim girl was having love relationship. She along with her entire family member has been made accused merely because she happens to be the mother of the co-accused Chhotu Yadav.

No.39223 of 2025(2) dt.09-07-2025 2/2 The victim girl has been recovered and in her statement recorded under Section 183 of the B.N.S. she has categorically stated that her family members wanted to marry her with an elder person and upon refusal they used to torture her accordingly she willingly fled with the co-accused Chhotu Yadav and has performed marriage.

Regard being had to the submission made by the parties, taking into consideration the fact that petitioner is the family member of the co-accused Chhotu Yadav and the statement of the victim girl recorded under Section 183 of the B.N.S., I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Madhepura in connection with Madhepura (Bharrahi) P.S. Case No. 1279 of 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023. praful/- (Anil Kumar Sinha, J) U T
