JUSTICE SANJAY PRIYA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Nathnagar (Madhusudanpur) P.S. Case No. 75 of 2017 instituted for the offence under Section-39(A) of Bihar Prohibition and Excise Act, 2016.

It is mentioned in the seizure list that 119 bottles of Royal Stag each containing 375 ml. foreign liquor have been recovered from Parti land near the house of this petitioner. In paragraph-3, it has been mentioned that petitioner has no criminal antecedent. The petitioner is in custody since 10-03-2017. There is no recovery from conscious possession of the petitioner. In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail

Patna High Court Cr.Misc. No.24272 of 2017 (2) dt.24-05-2017 2/2 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nathnagar (Madhusudanpur) P.S. Case No. 75 of 2017 to the satisfaction of learned Special Judge (Excise)-cum-2nd Additional Sessions Judge, Bhagalpur subject to condition that both the bailors should be close relatives of the petitioner.
