JUSTICE SANJAY KUMAR ORAL ORDER 05-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks regular bail in connection with Sasaram Town P.S. Case No. 412 of 2018 registered for offences punishable under sections 395, 397 of the Indian Penal Code and section 27 of the Arms Act (later on section 412 IPC has been added).

It has been submitted that the case has been registered against the unknown persons. The name of this petitioner surfaced in the confessional statement of one Shivendra Dubey, who besides the name of this petitioner, disclosed the name of other accused. The accused namely, Amit Kumar Dubey @

Patna High Court Cr.Misc. No.30649 of 2018 (3) dt.05-07-2018 2/2 Golden @ Golden Dubey and Bindeshwari Tiwari were apprehended. The police recovered Rs.45,000/- from the possession of Amit Kumar Dubey, who has been allowed bail in Cr. Misc. No. 31922 of 2018 and another co-accused has also been allowed bail in Cr. Misc. No. 33105 of 2018. The petitioner is in custody since 11.03.2018 having clean antecedent and he has not been put on TIP till date. The case of the petitioner stands on similar footing and so he deserves bail.

Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram Town P.S. Case No. 412 of 2018, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
