Petitioner seeks bail in Maharajganj P.S. Case No.63 of 2019 instituted for the offence under Section(s) 302, 120-B/34 Indian Penal Code.

Counsel for the petitioner submits that Petitioner is in custody since 18.03.2019 having clean antecedents. It is alleged in the written report that son of the informant, Chandan Prasad, was living with Most. Malti Devi @ Jyoti and her daughter Kajal Kumari for last two years. Son of the informant was taking care of Malti Devi and her daughter. Chandan Prasad was murdered by Malti Devi and Kajal Kumari with the help of unknown criminals by means of knife and they had fled away from the house.

The Sessions Judge has mentioned in the impugned order that police recorded confessional statement of co-accused, Malti Devi, and Sandeep. Name of the petitioner has come merely on suspicion. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Maharajganj P.S. Case No.63 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
