ANJANA MISHRA ORAL ORDER 27-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Gaurichak P.S. Case No.170 of 2014 for the offences under Sections 147, 148, 149, 341, 323, 324, 302 of the I.P.C. and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the present case has been initiated against the petitioner only because he is only neighbor of the main accused petitioner, namely, Abhay Singh, who is the father of the victim girl. The victim girl in her statement recorded under Section 164 Cr.P.C. has named one Suresh Singh of village- Daulatpur Dih. Learned counsel for the petitioner further submits that the present petitioner being one of
Patna High Court Cr.Misc. No.28907 of 2015 (5) dt.27-11-2015 2/2 the neighbors of the father of the victim girl has also been named in the present case. It is also submitted that the said Abhay Singh, father of the victim girl being main accused has already been extended the privilege of anticipatory bail vide order dated 25.6.2015 passed in Cr.Misc. No.14693 of 2015. So far as this petitioner, Ram Suresh Singh, is concerned he is not the said Suresh Singh as per the statement of the victim girl recorded under Section 164 Cr.P.C. rather he belongs to the District of Hazaribagh where has already settled. The person named in the statement is merely Suresh Singh and not Ram Suresh Singh.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, J.M., Patna City, in Gaurichak P.S. Case No.170/14 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
