Mr.Uday Pratap Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-07-2024 Heard Ms. Priya, learned counsel appearing on behalf of the petitioners and Mr. Uday Pratap Singh, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Piro P.S. Case No. 501 of 2023 registered for the offence(s) punishable under Sections 341, 323, 307, 507 and 34 of the Indian Penal Code.
3. As per the allegation made in the FIR, the accused persons named therein including the petitioners have assaulted on different parts of the body of the informant with an intention to kill her.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.44267 of 2024(2) dt.24-07-2024 2/3 petitioners submitted that there is general and omnibus allegation against petitioners no.1 and 4, while against petitioners no.2 and 3, who are husband and wife, is that of assaulting on the head and back of the informant, causing head injury and injury in the stomach, however, the injuries are not substantiated by the opinion of the doctor. There is case and counter case between the parties. Petitioners have clean antecedents.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.
6. In the facts and circumstances of the case, the petitioners, above named, are directed to be released on prearrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 4th, Bhojpur at Ara in connection with Piro P.S. Case No. 501 of 2023 , subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
7. The court below is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases, as what has been
