JUSTICE SANJAY PRIYA ORAL ORDER 23-05-2017 The learned counsel for the petitioner is permitted to make necessary correction in paragraph-10 of the bail petition in course of the day.

Heard learned counsel for the petitioner and the State. The petitioner seeks bail in G.R.P. (Mokama) P.S. Case No. 5 of 2017 instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(A) of Bihar Prohibition and Excise Act, 2016.

It has been submitted on behalf of the petitioner that there is no recovery from his possession. His name has been incorporated by the police. He is in custody since 19.2.2017. As per written report, country made liquors was recovered from a general bogey of train No. 18622 UP at

Patna High Court Cr.Misc. No.23678 of 2017 (2) dt.23-05-2017 2/2 Mokama Railway Station. One of the persons (petitioner) admitted that those articles belong to him.

The seizure list has been enclosed wherein it is mentioned that the country made liquor has been recovered from the general bogey of train No. 18622 UP at Mokama Railway Station.

It is mentioned in paragraph-3 of the bail petition that petitioner has clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Patna, in connection with G.R.P. Mokama P.S. Case No. 5 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
