JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 01.10.2016, in connection with Jagdishpur P.S. Case No. 23 of 2015, registered offences punishable under Sections 272, 273 and 290 of the Indian Penal Code and Section 47(A) Excise Act.

Allegation against the petitioner is that 140 litres of country made liquor has been recovered from him. It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the rather the same has been recovered from an auto, the petitioner has been implicated in this case only on the basis of assumptions, for which he has been in judicial custody since 01.10.2016 without having any criminal antecedent.

Patna High Court Cr.Misc. No.53849 of 2016 (2) dt.15-12-2016 2/2 Heard learned A.P.P. also.

Considering the aforementioned facts and circumstances, nature of offence, the period of custody and also that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Ara, in connection with Jagdishpur P.S. Case No. 23 of 2015.
