The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim has got her age recorded as 18 years when the court has assessed 17 years where she has stated that she of her own left the house and married with this petitioner and she was not being kidnapped by anyone.

No.46653 of 2014 (02) dt.20-04-2015 2/2 Considering the 164 Cr.P.C. statement of the victim girl, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Azamnagar P.S. Case No. 176 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
