JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On trivial issue, it has been alleged that the accused persons, so named therein, armed variously raided the house of the informant, brick-batted and during course thereof, it has been alleged that Vishram Manjhi and Raju Manjhi fired while petitioner, Babulal Manjhi threw bomb.

From perusal of written report, it is apparent that one bomb had fallen down near daughter in-law of informant while another bomb had fallen down at his roof. From the seizure list, it is apparent that both bombs were seized by the police which is yet to be examined by an expert. Therefore, there happens to be no explosion. Moreover, as is evident from the order sheet, none had sustained explosive

Patna High Court Cr.Misc. No.39930 of 2016 (02) dt.17-09-2016 substance injury. It is also apparent that counter-case bearing Guthani P. S. Case no.148 of 2014 has also been drawn up at the end of the petitioner. Apart from this, petitioner happens to be under custody since 15.07.2016.

Accordingly, petitioner, Babulal Manjhi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Siwan in connection with Guthani P. S. Case no.147 of 2014.
