ANJANA MISHRA ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with S.Tr. No.504 of 2008, arising out of Bagaha (Bhairoganj) P.S. Case No.438 of 2007, on summons having been issued against him under Section 319 Cr.P.C. Learned counsel for the petitioner submits that though the petitioner was earlier named in the F.I.R. registered under Sections 448, 341, 323, 324, 379 and 307/34 of the Indian Penal Code, the case was found to be untrue against him and accordingly, he was not sent up for trial. However, during the course of trial, some materials surfaced against him and consequently, the present process.

No.30860 of 2015 (3) dt.12-08-2015 2/2 Considering the nature of allegations made against the petitioner and the fact that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Bagaha, District-West Champaran, in connection with S.Tr. No.504 of 2008, arising out of Bagaha (Bhairoganj) P.S. Case No.438 of 2007, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. However, it is made clear that the petitioner must cooperate in the trial and present himself on each date. If, however, he is found absent on two consecutive dates, it will be open for the trial court to take appropriate action in accordance with law.
