The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code.

The allegation against the petitioner is of committing murder of the deceased Rupam Devi, the daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.08.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Only suspicion has been raised against the petitioner regarding his involvement. There is no

Patna High Court Cr.Misc. No.23632 of 2017 (3) dt.24-05-2017 2/2 other substantive evidence to suggest his implication in the present case. There is no eyewitness to the alleged occurrence. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Udakishunganj, Madhepura, in connection with Gwalpara P.S. Case No. 48 of 2015.
