2. The petitioner seeks bail in connection with Mahila Thana P.S. Case No. 105 of 2024 instituted for the offences under Sections 341, 323, 307, 354B/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.

3. As per prosecution case, the accusation against the accused persons including the petitioner is of harassing and torturing the Informant for dowry. Specific allegation has been made against the petitioner of making an attempt to commit rape upon the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. The informant is the daughter-in-law of the petitioner who resides at her paternal house. There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. He further submits that the petitioner is 59 years old and is unable to daily routine life. He further submits that the informant is a habitual litigant and she has also filed matrimonial case being Matrimonial Suit No. 327 of 2024 against her husband before the learned court of Principal Judge, Family Court, Balia. The petitioner has no criminal antecedent and is languishing in judicial custody since 05.03.2025 without any rhymes or reason. Charge-sheet has been submitted against the petitioner in this case.

5. On the other hand, learned A.P.P. for the State and the Informant have vehemently opposed the prayer for grant of bail to the petitioner.

6. Having heard rival contention of both the parties

No.43713 of 2025(4) dt.15-09-2025 3/3 and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner and the petitioner having no criminal antecedent, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Mahila Thana P.S.
