This application, for grant of anticipatory bail, arises out of Mohiuddinagar P.S. Case No. 28 of 2016, disclosing offences under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act.
It has been submitted on behalf of the petitioner that there is no allegation against the petitioner. He was standing on the road near the place of occurrence. It has also been submitted that there is a dispute between the parties due to election of Mukhiya.
Heard learned APP appearing for the State who could not controvert this fact.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Shri Atul Kumar Singh, learned Additional Chief Judicial Magistrate 4th, Samastipur in connection with Mohiuddinagar P.S. Case No. 28 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure and further that the petitioner will cooperate with the investigation of the case.
