JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-03-2022 Heard Mr. Satya Narayan Singh, learned counsel for the petitioner and Mr. Dinesh Singh, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Ekangarsarai PS Case No. 250/2020 registered for the offence punishable under Sections 341, 323, 325, 338, 307, 504, 506/34 of the IPC.

As per First Information Report, the petitioner along with other accused persons assaulted the son of the petitioner by means of Lathi, Danda, brick stone etc., due to which he sustained injury.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and from perusal of the

Patna High Court CR. MISC. No.49955 of 2021(2) dt.25-03-2022 2/2 FIR, it would be evident that petitioner and other accused persons are agnates of the informant and there is previous dispute between the two families and Shaymdev Singh who assaulted the victim by iron rod, has been granted bail by the learned court below itself. Petitioner is in custody since 08.04.2021.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that co-accused person, Shyamdev Singh has been granted bail by the learned court below, Charge-sheet has been submitted in the matter and the petitioner having no criminal antecedent, is in custody since 08.04.2021, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, GULANI SINGH be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Ekangarsarai PS Case No. 250/2020.
