JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 447, 341, 323, 504, 506, 307, 379 and 34 of the Indian Penal Code.

Allegation against petitioner is to have hit with iron rod upon the head of informant's daughter due to dispute. It has been submitted on behalf of petitioner that he has got no criminal antecedent. He is in custody since 29.8.2016. There is no allegation of tampering of witnesses against petitioner. It is a case and counter case between the parties. Nature of injury is said to be simple. Hence, no offence under Section 307 of the Indian Penal Code is made out.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.50530 of 2016 (2) dt.24-11-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Halsi P.S. Case no. 108 of 2016.
