JUSTICE PARTHA SARTHY ORAL ORDER 28-07-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Katihar Town P.S. Case no. 201 of 2020 registered under sections 420 and 406 of the Indian Penal Code.

As per allegation in the F.I.R., it is stated by the informant that a sum of Rs. 2.5 lacs in cash given to the petitioner to deposit in their account was not deposited by him and he usurped the same.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false. He has been falsely implicated in the case because of dispute relating to his salary with the informant. No incriminating article has been

Patna High Court CR. MISC. No.9875 of 2021(4) dt.28-07-2021 2/2 recovered from his possession. He is in custody since 27.8.2020 and has no criminal antecedent.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for 11 months, this Court is inclined to enlarge the petitioner on bail in connection with Katihar Town P.S. Case no. 201 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
