JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 447, 341, 323, 325, 307, 504 and 506 of the Indian Penal Code.

The allegation against the petitioner is that he forming an unlawful assembly with other accused persons named in the FIR armed with deadly weapons came to the door of the informant and abusing her started to assault with fists, slaps,lathi, danda etc. in course whereof this petitioner is alleged to have used khanti causing injury on the head of the informant due to which she fell down and thereafter other accused persons indiscriminately assaulted her.

On behalf of the petitioner it has been submitted

Patna High Court Cr.Misc. No.29251 of 2015 (2) dt.28-07-2015 2/2 that it is a case and counter case. The injury sustained upon the informant is simple in nature. It has also been contended that the accused persons have also sustained injury in course of the occurrence, which has not been explained by the prosecution. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Bhagalpur in connection with Jagdishpur P.S.Case No. 203 of 2013,subject to the conditions as laid down u/s 438(2) Cr.P.C.
