The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act.

Accusation is of kidnapping the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that under Section 164 Cr.P.C. statement the victim got her age recorded 19 years, the Court also assessed her aged 19 years but during medical examination of the informant the Doctor found her age between 17 years. She has also stated that she of her own married with the petitioner and wants to reside with him.

Patna High Court Cr.Misc. No.31013 of 2015 (2) dt.31-07-2015 Considering the statement under Section 164 Cr.P.C. of the victim, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Madhubani in connection with Basopatti P.S.
